Updates to the Hamilton County Stormwater District Regulations

Legal Notice

​The Ohio Environmental Protection Agency (EPA) issued a new Municipal Separate Storm Sewer System (MS4) permit on April 1, 2021, and a new Ohio Construction General Permit (CGP) on April 23, 2023. The District is updating its regulations, specifically Article I, Article III, and Article V, to reflect new or updated permit requirements and restore internal consistency. The updated regulations must be complete and in place by April 1, 2026, in order for the District to remain in compliance with the most recently issued EPA permits. 

The District’s regulations were updated to:
  • Meet new TMDL Performance Standards. The regulations are being updated to address new MCM 5 Total Maximum Daily Load (TMDL) performance standards outlined in the 2021 Ohio EPA MS4 permit. The District Oversight Board and Co-Permittees preferred regulation updates over other options to achieve compliance with this new permit. Therefore, the District is updating its regulations to require project owners to implement Ohio Construction General Permit Table 4b practices and/or green infrastructure practices, where feasible.
  • Achieve consistency between Articles. Clarifying language was added into the regulations to achieve consistency between Articles III and V.
The recommended updates to draft District Article I, Article III, and Article V Regulations with recommended updates will be posted to the District’s website for a one-month public comment period. You can access the updated regulations and provide feedback on the form below.   Please be sure to include your name, organization, and contact information along with your comments. All comments that include contact information will receive a response from the District.

​The following matter is the subject of this public notice by the Hamilton County Storm Water District (HCSWD). The complete public notice, including any additional instruction for submitting comments or requesting information, may be obtained at the HCSWD Website or Hamilton County Storm Water District, Todd B. Portune Center for County Government, 138 E Court Street, Room 700, Cincinnati, OH 45202. Ph: 513-946-4250. The HCSWD is posting updates to its Regulations, specifically Articles I, III, and V, for public comment from April 1, 2024, through April 30,2024. These regulations were updated in response to changes in the 2021 Ohio EPA National Pollutant Discharge Elimination System (NPDES) General Permit for Storm Water Discharges from Small Municipal Separate Storm Sewer Systems requirements for this permit cycle (2021-2026), and the 2022 updates to the Stormwater Discharges from Small and Large Construction Activities – General Permit. Written comments on Regulation revisions will be received through close of business on April 30, 2024. Comments may be submitted via this online form: (http://www.hcswd.org/regulations-update.html) or mailed to the address above. All comments should reference the HCSWD Regulation updates.
